** CLOCKS CHANGE IN U.S. ON SUNDAY 26 OCT **
************************************************************
TAG has heard some rumors that there is going to be a US free
listing day, but not when. The next one we predict is the annual
Christmas FLD that should occur around 19 Dec 2002.
************************************************************
** Snipers Take Heed ** ebaY's time clock has gotten very
unstable in the last week or so. If you use third party sniping
software, or are a dedicated direct auction sniper, you might
want to widen your bidding time margins, to allow for the ever
changing ebaY clock. This problem is even worse on ebaY
Germany, where rumor has it ebaY has prohibited the use of
third party sniper systems, though how they are going to prevent
them remains to be seen.

ebaY - On 15 Oct at 10:04:34 PT sellers reported the scheduler
function was not working. At 11:17:06 PT users reported
problems with advanced search, in that the words to exclude
portion was not working properly. At 12:10:32 PT more sellers
reported the scheduler not working, starting auctions
immediately rather than at the later scheduled time. At 16:05:49
PT ebaY reported their discussion boards were down from
14:02 PT to 15:40 PT. At 20:26:38 PT sellers reported getting
"This page cannot be displayed" messages whilst trying to pay
their ebaY bill.

On 16 Oct at 09:39:19 PT sellers continued to report problems
with the scheduler function not working. This was reported by
different sellers throughout the day. Auctions were listing
immediately rather than at the later scheduled time. At 12:20:27
PT users received messages that items using the gallery option
did not have their gallery image displayed, and received
messages from ebaY that the image was not available, despite
the image being present and accounted for when accessed
directly. At 12:28:36 PT the reports of scheduled being non
functional continued unabated. At 17:46:19 PT users reported
ebaY crashing. At 17:46:55 PT users received "Connection reset
by peer" messages whilst trying to access ebaY. At 17:48:45 PT
users "Unable to read URL from host cgi3.ebay.com:
Connection reset by peer" messages when trying to post on the
chat boards or trying to log in. At 18:06:58 PT users reported the
site having intermittent outages.   At 20:05:58 PT sellers reported
listing with SY"I2.0 was locking them in a loop, unable to
complete listing an item.

On 17 Oct at 12:16:01 PT a seller reported that after closing their
ebaY PayPal account ebaY sent Auction Request Cancellation
emails to all the seller's previous customers who had open
payment request invoices on PayPal because they paid the
seller via a different link or method.   When they received the
email, many of the buyers contacted the seller to find out what
was going on. The seller explained and offered the buyer a
premium for making another purchase from the seller's website,
and managed to make hundreds of dollars off ebaY as a result.
At 12:36:47 PT, users reported increasing problems with PayPal.
Sellers were no longer receiving their payment cleared email
messages from PayPal. At 12:24 PT buyers reported receiving
Internet Explorer Script Errors whilst trying to search for items.

On 18 Oct at 04:59:48 PT ebaY posted that their discussion
boards were down from 04:30 PT to 04:54 PT. At 16:03:12 PT
sellers reported Mister Lister down. ebaY posted at 16:32:50 PT
that ebaY Billpoint payment system was down from 16:00 PT to
16:28 PT. At 16:35:16 PT items submitted through ML were
showing up as fixed price items.   Sellers also reported that
auction listings from third party service providers were going
through sporadically or not at all.   Sellers trying to revise items
received password invalid messages. Bidders were also
prevented from placing bids on auctions that originally had a Buy
It Now price, higher that the items Buy it Now price. They received
a message saying, "cannot accept bid higher than buy it now
price". Sellers reported that PayPal notices were arriving two
days after the item had been paid for.

On 19 Oct at 12:54:34 PT users trying to leave feedback received
messages saying the item was invalid. At 13:03:42 PT, sellers
could not list using the SYI2.0 form. They kept getting caught in
endless page loops and could not proceed. At 15:05:46 PT
more sellers reported being unable to get past the payment
window on SYI2.0. These problems continued to be reported
through 16:12:22 PT.

On 20 Oct at 09:57:46 PT sellers reported the scheduling
feature was not working. it would list the item immediately rather
than when the seller wanted it to start. At 14:57:58 PT users
reported slow page loads. At 16:13:06 PT users reported being
unable to sign in, receiving a message saying "Your sign in
information is not valid" Please try again. On trying again the
user would get an image of a 4 digit, colored number to enter
along with the user ID and password. At 19:01:00 PT users
reported that search was returning "site not responding"
messages. At 19:01:29 PT cgi 6 went down, taking sellers lists
down. At 19:05:53 PT sellers reported that listing was very slow,
and the site slow across the board. At 19:09:29 PT My ebaY
went down. The site came back up at 19:24:55 PT. At 19:24:59
PT ebaY posted that there were "intermittent issues with certain
eBay systems" At 19:36:25 PT ebaY reported that there were
intermittent issues from 19:00 PT to 19:23 PT, including listing,
My ebaY and bidder and seller search. At 21:20:07 PT users
reported that Turbo Listed items caused problems on relists,
forcing the seller to re-enter their images. At 21:37:10 PT users
received "Page cannot be found" messages when viewing
seller's lists.

On 21Oct at 10:48:18 PT sellers reported that they were finally
able to use the scheduling feature successfully. TAG hopes
ebaY auto refunded all the fees for those whose listings failed to
schedule. At 15:35:36 PT, users reported intermittent outages
across the site, with the intermittent outages occurring through
20:04:27 PT.

On 22 Oct at 05:00:39 PT ebaY posted that their threaded boards
were down from 04:25 PT to 04:42 PT.   At 12:18:00 PT ebaY
posted that sellers using Turbo Lister were getting error
messages when trying to update or upload to ebaY. At 18:44:34
PT sellers reported having "tremendous trouble" with Turbo
Lister. The latest update resulted in an inability to use the
program. At 19:24:54 PT more sellers reported problems with
Turbo Lister, receiving "not responding" messages whilst TL
was trying to download the latest update. At 21:17:01 PT sellers
reported they could not get TL to work all day, and the problems
continued unabated.

On 23 Oct at 07:21:12 PT sellers continued to report the
problems with Turbo Lister.   This was not affecting all sellers,
but no one could figure out exactly what factors were allowing
some users to use it and others not. Sellers also reported that
TL was not allowing importation of Mister Lister collections.
These problems continued throughout the day.

On 24 Oct at 12:48:55 PT sellers trying to upload Turbo Lister
collections could not do so.   TL problems were reported at
14:25:01 PT at15:06:14 PT and through 18:07:16 PT. Most
problems appeared to be involved with the latest updates of TL.

ebaY took their site down for maintenance on Fri 25 Oct from
01:00 PT until 03:00 PT. At 13:41:27 PT sellers reported
problems with the calculate fees feature of Turbo Lister. Other
sellers had no problems.   At 13:59:02 PT sellers reported
messages saying network problems are preventing Turbo Lister
from communicating with ebaY.

TAG STRONGLY recommends that, if a seller feels that any of
the ebaY outages and glitches appears to have negatively
impacted the sale of any of their auctions or listings of any type,
request refunds. Don't pay for service if you don't receive it.

TO REQUEST REFUNDS from ebaY go to
http://www.auctionguild.com/generic.html?pid=33
Don't take NO for an answer, keep requesting until you get them.

Pink Quote of the Day I -In a Wall Street article - Cubicle Culture
By Suein Hwang   Worker Slogans Find a Home On This Side of
Great Wall cubicle-@wsj.com - in talking about the
employee cards ebaY employee's wear,
Kevin is quoted, ""The principles are incredibly important, and as
you can imagine it is far more challenging to get them across as
the company grows," says eBay spokesman Kevin Pursglove.
He reads aloud eBay's five principles, then silently stares at
them for a few seconds. "I thought there were nine, to be honest
with you," he mutters"" Hwang said, " Despite the banners, the
posters and the endless reminders, it seems some corporate
messages still don't really sink into the minds of all tagged
workers, or even managers, who still can miss the message."
All of those who know ebaY best are aware that this is nothing
but propaganda, not only has the message not sunk in, it is
used by management to pull the wool over the eyes of anyone
who believes that the management believes it - or even knows
what is says....

Pink Quote of the Day II - In a memo to ebaY employees trying to
justify her unethical at best and illegal at worst, kickbacks from
Goldman Sachs, when her name appeared prominently on
congressional committee list, Meg Whitman said, " First, let me
say that a fundamental tenet of my life is to conduct my personal
and professional activities under the highest ethical standards.
Some of you have heard me say that whatever you do in life, you
should never under any circumstances compromise your
integrity. I live by that rule and know that Pierre, Jeff and Bob do
too." and " The last 24 hours have been painful for me. There is
nothing worse than having your integrity questioned under
circumstances where you know that you did nothing wrong and
followed all the rules." TAG notes that Meg finds anything ethical,
as long as it makes her more money. Meg talking about her
high standard of ethics is akin Enron's code of ethics, visible on
paper but no where to be seen in her or ebaY's actions. TAG
wonders that this accusation should bother Meg so much, or is it
just that she was caught by someone she can't easily dismiss
and ignore.

Board Quote of the Day I - Posted by marginally*marginal on 21
Oct at 20:01:49 PT said, "Actually, I think the techies do it
because all the bean counters are at home and out of their hair.
And eBay makes all their changes on a hot system, which is why
it's so flaky. They don't really have a smooth integration system
(like AOL for example) that propagates changes seamlessly.
That, and they don't test their software until they put it up live.
Then they sit back and see what breaks, and stick bandaids on it
until the bleeding is mostly under control. Lather, rinse, repeat.'
and at 20:16:37 PT, "heh, you don't know the half of it, com. eBay
bought into FAST (the Norwegian engine) in the middle of
August, 2001 (article here:
http://siliconvalley.internet.com/news/article.php/867351 ) and 14
days later, the company goes into reorganization, laying off half
of it's engineering staff (article here:
http://www.pandia.com/sw-2001/50-fast.html ) and this was from
a company that had one of those meteoric rises, with all sorts of
inside players (Lycos, Dell, etc.) at the beginning (1999 story
here: http://boston.internet.com/news/article.php/262871 )
... As to why they didn't buy into google, who knows? It would be
NICE to have googles relevance engine, spell correcting, and
smart search, and automatic translation... But, hey, this is eBay."

BQOD II - Posted by anythnguzd on 24 Oct at 05:06:15 PT said,
"Unable to list; unable to search. It is a 50 - 50 chance whether
the site is up or down. With this type of performance, eBay, how
in hell is anyone supposed to get anything done - here or
elsewhere!!?? People have better things to do than to sit around
and hope and wait for your site to get operating. Because of this,
people are getting frustrated and are no longer listing or buying.
eBay you are dying a slow death. It was the many small blows of
an axe that felled great forests!!!"

Meg Whitman wrote an internal memo on 4 Oct to defend her
$1.8 million gain from the initial public offerings she received
from Goldman Sachs. She said the practice of getting these
kickbacks was, and still is, legal. The memo from Whitman,
posted on internalmemos.com, came after the House Financial
Services Committee earlier this month named Meg, Pierre, Jeff
Skoll and Benchmark's Bob Kagle, as recipients of hot initial
public offerings.   Meg said the disclosure by the congressional
committee was "painful" because "there is nothing worse than
having your integrity questioned under circumstances where you
know that you did nothing wrong and followed all the rules."

TAGnotes readers should note that Goldman Sachs got the
ebaY IPO, and was part and parcel of the launch that denied the
"founding community" of 200,000 ebaY users, their promised 10
shares of IPO priced stock. Meg was directly responsible for this
broken promise (see eBoys) and TAG wonders how many "legal
favors" Goldman Sachs did her as a result of her spoke in the
wheel action. At least 1.8 mil worth it appears.

TAG also finds it interesting that we were contacted by Goldman
Sachs on 26 June 02, with a request to discuss our interaction
with ebaY, and provide Goldman Sachs with a contact list for
TAG personnel. When we inquired as to what they wanted from
us and why, they said they were doing online auction industry
research for their investors. When we gave them our consulting
fee rates, they declined to pay, so we declined to participate.
TAG has always wondered if this was a fishing expedition for
ebaY. More "legal favors"?

-----------
Some individual users of ebaY's backend for the ebaY API were
quoted a price of $1,000 per year. A rate of $100 until June 2003
was also given. These users are currently using the Mister
Lister backend to upload their auctions to ebaY, and ebaY is
closing down this route.   The fees we have seen for commercial
API users follow: Access to eBay's API is licensed based on the
number of calls or database requests made through the API to
eBay's database -- call volume per day. If your eBay API enabled
application requires up to 35,000 calls to eBay per day, you are
in the API "Select" pricing tier, which is $3,500 per month. Over
35,000 calls per day, up to 100,000 calls per day, you are in the
API "Premier" pricing tier, which is $10,000 per month. Over
100,000 calls per day is licensed on a case-by-case basis

-----------
ebaY has launched the previously announced warranty program
for computers and consumer electronics. For a change, TAG
feels this might be a good thing for buyers and sellers. The
program is run by NewCorp.Com and ebaY does not get
involved in the deal - a very good thing, as ebaY involvement
would be sure to disrupt the process. The worst ebaY can do, is
mess up the kickback the seller gets for every item they sell that
a buyer purchases a warranty for (if the seller advertises and/or
solicits the warranty or not). TAG would like to know what ebaY
is earning on each warranty sale.

Warranties are available on items it would not have been in the
past - used items under 5 years old and new items without
manufacturer warranty. The buyer decides if they want it and they
pay for it. The buyers deals directly with the warranty company
so there is no further responsibility for the seller.   The warranty
goes into effect 30 days after the sale, and is NOT of value for
items that come with a manufacturers warranty, as the NewCorp
warranty starts after 30 days regardless of manufacturer
warranty, and the buyer has to go to the manufacturer first
anyway if they have a manufacturer's warranty. Like any
insurance program, NewCorp is betting that you will buy a
warranty and not need it, and the buyer is getting peace of mind
knowing that if they need the warranty, it will be cost effective for
them.

are cost effective. For some good information about warranties

Buyers are also encouraged to check their state's website for
laws that govern warranties in their state. For example, here is a

Meg posted her third quarter message on the MAB. She
announced another "outstanding" quarter, but no commensurate
reward for sellers who make ebaY so profitable. ebaY has even
held several free listing days on the not so profitable ebaY sites,
but not on ebaY US. So as usual, Meg is spouting propaganda,
but not putting her money where her mouth is by giving sellers
the financial break and reduction in fees they deserve.

ebaY has a Mister Lister category update available for download.
When a seller uploads a collection through Mr. Lister, ebaY will
display a message prompting the download.   Choose "Yes" to
open to the download. If you do not want to download, make
sure you use current category numbers in your listings.

-----------
ebaY has a new version of Turbo Lister to download. Some
users have had success completely removing their last version
of TL, and doing a new download, rather than updating. The new
version has:
* Support for ebaY Motors categories
* Support for Real Estate categories, and the Real Estate Ad
Format
* Support for ebaY Canada, ebaY Italy and ebaY Taiwan
* Support for Sothebys.com and ebaY Live Auctions (for
pre-approved sellers)
* CSV (comma separated values text files) import and export
* The "included in shipping" option for insurance
* Item IDs for uploaded items now appear in the Turbo Lister
Activity Log
* New WYSIWYG design features include "zoom", buttons to add
hyperlinks and images, and undo and redo

Current users of Turbo Lister can upgrade their program by
selecting, "Tools" > "Check for Program Updates" in the
program.
To download Turbo Lister for the first time, or for more
information, visit http://pages.ebay.com/turbo_lister/

-----------
As TAG views it, ebaY has figured out a way to promote their
corporate sellers over Christmas, that will leave their smaller
sellers out in the cold, whilst spouting propaganda that they will "
level the electronics playing field". ebaY is running a promotion
whereby sellers who provide free shipping in Consumer
Electronics Computers & Office Cameras & Photo Networking
Musical Instruments and Video Games, get special links and
logos. http://www.ebay.com/freeshipping_electronics/

In addition to providing free shipping (something most small
sellers can't possibly afford), sellers may buy a gallery image for
the "free shipping" logo in the gallery image spot. ebaY says
they will do direct marketing e-mails and site-wide advertising
placements, along with promoting "Free Shipping" on the home
page. This will be to the detriment of sellers who can't afford
ebaY's largesse, as many buyers will expect free shipping.

To participate -
1.Insert this word anywhere in the title of all Electronics item
listings you wish to include: Free Ship, Free Shipping or
Shipfree.
2.Provide free shipping to the buyer of any item with Free Ship,
Free Shipping or Shipfree in the item description.
3.Use the Free Shipping icon in your listings or as a Gallery
image.

Stores Fixed Price listings are not included, though we don't
know what this means unless it is that the listing wont show up
in search.

In TAG's view, if ebaY was serious about leveling the field with
this promotion, they would reimburse the small sellers all or part
of the shipping fees. ebaY can afford it with their record breaking
profits.

-----------
ebaY is now also emphasizing electronics with an ebaY

-----------
TAG sees that when ebaY comes up with a bad idea that users
hate and opt out of, ebaY keeps pushing the idea until they figure
a way to force it down the users throats, maybe a little more
sugar coated to try to make it more palatable. This is so with
"More Items You May Like". This feature puts items on the My
ebaY bidding/watching tab.   Buyers can minimize this section, or
eliminate them by saying no in the My ebaY preference tab.   As
usual, this is opt out and not opt in

ebaY says they will list items "that match a buyer's general
interests, but we will actively try to show items that do not
compete with other items that the buyer has recently bid on or
bought." No doubt they will be as annoying and ineffective as the
emails ebaY forced on buyers. It will be interesting to see
whose products get shown, and wonder what criteria ebaY will
use to decide this issue. To try to bolster ebaY's failing gallery
feature, sellers must use the gallery option on their auctions to
have their items show up. For an example, go to -
http://pages.ebay.com/community/news/merchmyebay_preview.

Over the next two weeks, ebaY will test a text only version of the

---------
Yahoo Auctions is now promoting a Front Page Featured
Showcase, where sellers can promote their auctions. Sellers
who choose to join this showcase will receive a special icon next
to their listings. These items also have the chance to rotate on
the front page of Yahoo Auctions and on the relevant top-level
category. For example, if you submit a baseball card, it may
rotate on the front page of Yahoo Auctions and on the Sports
Cards & Memorabilia category page.

If you participate in this Front Page Featured Showcase costing
$3. per day per auction, you can use the other periodic
showcases for no extra charge. Front Page Featured Showcase
is restricted to sellers who have been a Yahoo user for a
minimum of 60 days, have a minimum rating of 10 or have a
